The Electoral Public Ministry (MPE) of Alagoas filed a request with the Regional Electoral Court (TRE‑AL) to block the registration of Yale Barbosa Fernandes as the vice‑gubernatorial candidate on the ticket headed by former Transport Minister Renan Filho. The MPE contends that Fernandes did not effectively resign from his commissioned positions in the Arapiraca city hall within the periods required by electoral law.
According to the MPE’s submission, Fernandes was appointed secretary of the General Coordination of Institutional Articulation in November 2025 and allegedly resigned effective 1 April 2026. However, the prosecutors say they could not locate the corresponding exemption orders in the Official Gazette of Alagoan municipalities. Moreover, they allege that immediately after leaving the secretariat, Fernandes was appointed as a Special Technical Advisor I in the Municipal Secretariat of Planning and Budget, receiving the same salary of R$ 11,800. The MPE argues that this succession of commissioned roles requires a substantive analysis beyond formal resignation acts, citing transparency‑portal records and public references that continued to identify him as a government secretary after his purported departure.
The defense presented by the MDB of Alagoas asserts that Fernandes left the secretariat on 1 April 2026 and was removed from the advisor role on 30 June 2026, both dates falling within the six‑month and three‑month pre‑election windows, respectively. The party cites exemption decrees GP № 311/2026 and GP № 855/2026, functional registers and transparency‑portal data as proof of compliance. Regarding continued references to Fernandes as “secretary of Government,” the MDB characterizes them as honorific treatment akin to that given to former officials, not evidence of ongoing employment.
The TRE‑AL will now evaluate whether the candidacy remains valid. If the court upholds the MPE’s challenge, the Fernandes‑Renan Filho ticket could be removed from the ballot; otherwise, the campaign proceeds as registered.
